VIVAnews - The Supreme Audit Agency (BPK) suspected Boedi Sampoerna and Robert Tantular had engineered the US$ 42.8 million or Rp 400 billion deposit split in PT Bank Century Tbk on November 16, 2008.
The allegation is part of Supreme Audit Agency (BPK)’s 500-pages long investigative report on Bank Century case obtained by VIVAnews. The deposit split was fabricated to allow payment by the Deposit Insurance Agency (LPS) in order to anticipate Century's closing.
“The fabrication was a manipulation done by RT (Robert Tantular) and BS (Boedi Sampoerna),” the complete version of the report reveals.
It all happened when Bank Century was standing on thin ice. They were facing possible termination. Century experienced its initial meltdown due to clearing failure on November 13, 2008. The bank was also suffering from liquidity problems which forced it to lodge short-term funding to Bank Indonesia.
According to BPK, the split started on November 15, 2008, when Tantular ordered KPO Senayan leader LW to make him 247 pieces of negotiable certificate deposit (NCD) which was worth Rp 2 billion each using nominated IDs.
LW acquired the nominated ID from Human Resources Division Head initialed RMT. The IDs belong to Bank Century applicants who had not been processed by the division. RMT submitted all of the IDs on November 17, 2008.
Moreover, based on the interview with Tantular on October 9, 2009, the split to NCD would be set out using the names of Sampoerna’s employees.
The NCD were later passed on by the deposit division to KPO Senayan to be given to Tantular and Sampoerna, according to the cover letter sent to Tantular on November 16, 2008.
Based on the court verdict no 1059/PID.B/2009/PN.Jkt.Pst made on September 10, 2009, Sampoerna agreed to follow Tantular’s suggestion to split the deposit in pieces to make it easier to cash out. Sampoerna asked the split to be under his or his company’s name. But, Tantular suggested NCD instead, which was rejected by Sampoerna.
Sampoerna later transferred US$ 96 million from Surabaya to Jakarta. Of the number, US$ 18 million was embezzled or borrowed by Tantular while US$ 42.8 million was broken down on November 16, 2008.
Five days later, on November 21, 2008, the Financial System Stability Committees, which was led by Finance Minister Sri Mulyani, decided to bail Bank Century out. The committees did not close the bank down despite opposing opinions.
After Century was taken over by the LPS, Sampoerna’s PT LSB sent a letter signed by Sampoerna on December 1, 2008, to Bank Century President Director stating that Sampoerna never approved the NCD creation. Sampoerna asked Century to return to deposit forms which are worth US$ 1 million each.
On December 17, 2008, Sampoerna returned the NCD to Bank Century. Despite his NCD possession, Sampoerna told Century that he never approved the deposit placement in the 247 NCD.
Century then changed the NCD into 140 pieces of deposit certificates which were worth US$ 1 million on June 15, 2009, under the name of PT LSB. Extension was done every month.
Tantular’s attorney, Denny Kailimang said the deposit split was carried out because Sampoerna asked Tantular to bail his deposit. “Because Sampoerna trusted Robert and Sampoerna joined Century because of Robert. That’s why he asked Robert to secure his money,” Kailimang said at the House of Representatives on Monday, January 11.
He also did not deny the allegation on Tantular and Sampoerna conspiracy. Tantular, who was not one of the bank’s managers, knew about the diversion of Sampoerna’s US$ 96.5 million worth of money from Surabaya to Jakarta on November 14, 2008.
Meantime, Sampoerna’s attorney, Eman Achmad said the Sampoernas would clarify BPK’s findings.
