Australia Repeals Allegation on Paper Company

VIVAnews - The Australian government has repealed its toilet paper dumping allegation against three Sinar Mas companies on January 12, 2010.

The companies, which were charged with the allegation in April 2008, are PT Lontar Papyrus, PT Pindo Deli Pulp and Paper Mills (Pindo Deli), and PT Univenus.

Trade Industry’s International Trade Security Directorate General Director, Ernawati said toilet paper produced by the three companies have been exempted from the anti-dumping tax (BMAD) which was imposed on December 31, 2008 and took effect on January 1, 2009.

The amount of BMAD was around 33 to 45 percent.

“That’s why the import duty that must be paid by Sinar Mas could be resumed to regular tariff, “Ernawati told VIVAnews over the phone on Wednesday, January 13.

According to her, the revocation was done because the investigation conducted by local authorities was not able to prove that Australia’s domestic industry was injured by the goods imported from Indonesia.

Chinese producers, who were facing the same accusation, were also acquitted.

Pindo Deli Deputy Director Arvind Gupta acknowledged the report saying that the Australian Attorney General has lifted the dumping charge against the toilet paper produced by his company.

The revocation indicates that all of the taxes paid must be returned and there would be no additional charges in the future.

Gupta said the revocation was the result of re-investigation carried out by the Australian Customs and Border Protection Service (Customs) based on the findings discovered during the initial investigation in early 2008 by imposing the BMAD.

Afterwards, Pindo Deli requested to re-analyze the tax implementation, which referred to the results of the investigation concluding that imported paper from Indonesia and Tiongkok has inflicted injuries to Australia’s toilet paper industry.

The injuries include market share loss, price depression and suppression and profit decrease.

“Pindo Deli immediately asked for a re-analysis because the conclusion was deemed inconsistent with the Australian laws and WTO’s anti-dumping agreement,” Gupta said.

He also said the Australian Trade Measures Review Officer (TMRO) agreed that the Customs’ conclusion was invalid and suggested JPU to accept TMRO’s recommendation.
