VIVAnews - The National Resilience Institute (Lemhannas) Governor Budi Susilo Supandji said the Indonesian National Military (TNI) has the authority to be directly involved in the response to criminal acts of terrorism. This authority is based on the law.
"The TNI can legally participate in tackling terrorism," Budi said on Monday, August 1.
Budi said the military has the power to engage in anti-terrorism campaign, which is made legal by Article 7 of Law No. 34/2004 on Indonesian Military. The Article states one of the main tasks of the TNI regarding military operations other than war is that of anti-terrorism scheme.
In addition, the National Security Act (Kamnas) which is currently still being prepared by the House can also function to strengthen the authority of the TNI. "And that secures the military’s function to fight terrorism more. But no ordinary person commands the TNI," he said.
According to him, the liberation of Indonesian citizens who were detained by Somali pirates some time ago has reflected the importance of the TNI's role in combating terrorists. "There are some scientists’ opinions which distinguish terrorism from piracy. But some other opinion says terrorism and piracy are the same," said Budi.
"The event in Somalia shows the involvement of TNI. It can be a jurisprudence."
According to Budi, if the TNI was not involved, the progress of terrorism acts in the mode of piracy will not be noticed.
However, he went on, the military cannot be commanded easily. The TNI can only be utilized through the command of the commander in chief, that is the president. "So no ordinary person can command the TNI. The military moves on the orders of the president through the TNI commander," he said.
