VIVAnews - Prita Mulyasari filed a complaint at the Judicial Commission (KY) on alleged ethical code violation committed by panel of judges of the cassation court who earlier ruled her guilty of defaming Omni International Hospital.
She and her lawyer, Slamet Yuwono, arrived at the Judicial Commission at 10:15 a.m. "We would like to report an alleged violation ethical code committed by the panel of judges," Slamet told reporters at the Commission’s office, Jakarta, on Monday.
In the civil case verdict, Yuwono said, what Prita did was not considered defamation against Omni International Hospital. The civil case verdict should have been used as the basis for the judge in the ruling.
"There are conflicting issues between the verdict on the civil cases and that of the criminal cases. We filed a report on alleged violation against ethical code as the judges did not carefully examine the case," said Yuwono. "We ask the Judicial Commission to conduct examination into the panel of judges in the criminal case’s appeal," he added.
Although not all judges in the panel for the criminal case appeal agreed to rule Prita guilty, according to Yuwono, the dissenting opinion should also be examined by the Judicial Commission. "Judge Saman Lutan had dissenting opinion, but we think he should also be examined by the Judicial Commission to know why he could make such an opinion," said Yuwono.
The Supreme Court (MA) found Prita Mulyasari guilty of spreading email of criticism against Omni International Hospital through the internet. She was sentenced to six months in jail with a year of probation.
This ruling is quite the contrary to the civil case verdict. On September 29, 2010, the panel of Supreme Court judges led by Harifin Tumpa passed the civil lawsuit cassation filed by Prita against Omni International Hospital. With the issuance of the verdict, Prita was let go of the compensation worth Rp204 million.
