VIVAnews - Two foreign nationals from Kuwait and Australia were sentenced to 20 months of imprisonment for the case of human smuggling. The verdict was passed by the panel of judges chaired by Nurhadie at Cibadak District Court, Sukabumi regency.
The two suspects named Hedar Ali Bin Ali Muhamad, an Australian, and Abdul Qidir Basir a.k.a. Abu Husein, a.k.a. Abu Ali, a Kuwaiti citizen.
"The defendants were found guilty of violating Article 50 of Law No. 9 of 1992 on Immigration in conjunction with Article 55 point 1 of the Criminal Code and sentenced to one year and eight months in prison," said the panel of judges in the verdict trial, Tuesday.
The verdict of Cibadak District Court panel of judges consisting of Nurhadie, Nur Aslan, and Rosdiani, was lighter than the demand of the Public Prosecutor of Cibadak court and West Java High Court, which was two years and six months in jail for both the convicts.
As regards the results of the trial, the convicts still mull over the judges’ ruling.
Meanwhile, public prosecutor of Cibadak District Court, Noeniek Triana, said she was still undecided about the sentence imposed by the presiding judges, as it is lighter than what the prosecutor demanded. "We are undecided about the verdict handed down by judges, because it is lighter than what we demand," said Noenik.
The case stemmed from the arrest of 46 illegal immigrants from Iran and Iraq in September 2010. The immigrants who planned to cross the sea to Christmas Island, Australia were caught in Palampang beach, Ciwaru village, Ciemas district, Pelabuhan Ratu, Sukabumi, West Java. As the case developed, the police named two suspects namely Hedar Ali Bin Ali Muhamad, an Australian national, and Abdul Qidir Basir a.k.a. Abu Husen, a.k.a. Abu Ali, a Kuwaiti.
