Papua Regent Facing Jail in Graft Scandal

VIVAnews - The Supreme Court declined an appeal filed by Regent of Boven Digoel, Papua, Yusak Yaluwo. Yusak will still have to serve a sentence of five years in prison. However, this decision is not unanimous.

The cassation panel which examined the appeal of this case consisted of Artidjo Alkostar (chairman), Syamsul Rakan Chaniago, and MS Lumme. The verdict on the case was passed on May 10, 2011. The judge who had a dissenting opinion was Syamsul Rakan Chaniago, who believed Yusak should be released.

The ruling that applies was made by the Jakarta High Court sentencing Yusak to five years in prison and required him to pay compensation amounting to Rp37,271,520,000.

The Supreme Court’s website says the Cassation panel was of the opinion that the first- and the appellate courts were not violating procedures.

"The action of the Cassation Applicant has a causal relationship with the financial losses worth Rp66,777,767,123 according to Report of State Loss Calculation compiled by the Supreme Audit Agency (BPK)," the Supreme Court considered.

Previously, the Anticorruption Court sentenced Yusak Yaluwo to four years and six months in jail. Yusak was proved of embezzling the Boven Digul regional budget of 2006 and 2007.

In addition to imprisonment, the judge also obliged Yusak to pay a fine of Rp200 million subsidiary six months of detention. In addition, Yusak was also required to indemnify state losses totaling Rp45.7 billion, of which failure to pay will increase his imprisonment sentence by two years.
