President Joko Widodo Officially Signs Sexual Violence Law

VIVA – President Joko Widodo has officially signed the Act Crime of Sexual Violence or locally known as UU TPKS. Jokowi signed the law number 12 of 2022 concerning sexual violence on Monday, May 9, 2022.

This sexual violence Law has also been uploaded to the official website jdih.setneg.go.id. On the website, this Law is written the Law of the Republic of Indonesia Number 12 of 2022 concerning the Crime of Sexual Violence. This law was also signed by the Minister of Law and Human Rights, Yasonna Laoly on the same date.

This law is included in the State Gazette of the Republic of Indonesia of 2022 number 120 and an additional State Gazette number 6792.

As previously reported, the House of Representatives or locally known as DPR has finally passed the Sexual Violence law (RUU TPKS) into law. This ratification was carried out at the Plenary meeting of the DPR RI for Session IV Session Year 2021-2022 which was held on Tuesday, April 12, 2022.

Based on the draft Law on TPKS, there are nine types of sexual violence. This is as regulated in Article (4) Paragraph (1) of the TPKS Law.

The nine crimes of sexual violence include:
- Non-physical sexual harassment
- Physical sexual harassment
- Forced contraception
- Forced sterilization
- Forced marriage
- Sexual torture
- Sexual exploitation
- Sexual slavery
- Electronic-based sexual violence

In addition to the nine types of sexual violence, Article (4) Paragraph (2) of the TPKS Law contains 10 other types of sexual violence, such as:

- Rape
- Obscenity
- Sexual intercourse with children
- Obscene acts against children
- Sexual exploitation of children
- The act of violating decency that is against the will of the Victim
- Pornography involving children
- Pornography that explicitly includes violence and sexual exploitation
 - Forced prostitution
- The crime of trafficking in persons intended for sexual exploitation - Sexual violence in the domestic sphere

Then, there is also the crime of money laundering whose original crime is a crime of sexual violence and other crimes that are stated as crimes of sexual violence as regulated in the provisions of the legislation.

So, with the existence of the sexual violence Law, the police have a legal rules for handling cases of sexual violence. Including, not being able to refuse the victim's report for any reasons until they give the protection for victims.
