Constitutional Court to Resolve Election Dispute in 14 Working Days

Jakarta – Deputy Chairman of the Constitutional Court Saldi Isra revealed the readiness to formulate technical matters of the trial including the division of time for the General Election Results Dispute (PHPU) trial or the 2024 Election dispute.

The judges will work optimally in the Judges Consultative Meeting (RPH). He said that the Constitutional Court would maximize the deadline for hearing the 2024 Election dispute.

There are two applications for the 2024 Presidential Election PHPU, namely those submitted by the 01 Anies Baswedan-Muhaimin Iskandar pair registered under number 1/PHPU.PRES-XXII/2024 and the 03 Ganjar Pranowo-Mahfud MD pair registered under registration number 2/PHPU.PRES-XXII/2024.

"We have also discussed the readiness of our staff to support, especially substitute clerks and case analysts, yes, to deal with this, and we have also discussed that," Isra said on Tuesday.

He further stated that the two applications would be held separately, including the first hearing on Wednesday (March 27) to listen to the main petition of the applicant.

"From morning until noon, the application of 01 (Anies-Muhaimin). Then, in the afternoon, we will hear the application from serial number 02 (Ganjar-Mahfud), meaning the second application," Isra informed.

On the other hand, Isra is confident that his party will complete the 2024 Election dispute hearing by the given deadline, which is 14 working days.

He understands that the deadline for the PHPU Presidential election is very limited. However, he ensures that the dispute hearing will not exceed 14 working days.

"Legally, it must be completed within 14 working days, it isn’t matter of being sure or not, but it must be a maximum of 14 working days," he said.

The Constitutional Court has registered the application for a dispute over the results of the 2024 presidential election (PHPU) into the electronic Constitutional Case Registration Book or e-BRPK and issued a Constitutional Case Registration Deed (ARPK) on Monday.

Then, on Wednesday, the Constitutional Court will hold its first hearing in the form of a preliminary examination plenary session. 

In this session, the Constitutional Court examines the completeness and clarity of the applicant's application material and the validity of the applicant's evidence. 

The day after, March 28, the Constitutional Court began the plenary session of the trial examination.

The plenary session of the trial examination will continue on April 1-18, 2024 with several activities, namely examining the petitioner's application; examining the answers of the Respondent, Related Parties, and Bawaslu; certifying evidence; examining written evidence; hearing witness testimony and hearing expert testimony.

After that, on April 19-21, 2024, a Consultative Meeting of Judges (RPH) will be held where the Constitutional Court judges will discuss the dispute over the results and make a decision. 

Then, a plenary session to pronounce an interlocutory decision or final decision or decree will be held on April 22, 2024.
