West Papua’s Lawmakers Declared Graft Suspect

VIVAnews – The Papua High Court declared 44 members of the People's Representative Council of West Papua suspects of graft. Thus, only one person out of the council members who was free of the allegation. The 44 lawmakers allegedly embezzled the people;s money amounting to Rp22 billion.

They became suspects along with the Secretary of the West Papua Provincial Government. The high court has requested a warrant to the Home Affairs Minister  to inspect them.

Deputy Chief of Papua Prosecutor's Office, Hardjono Tjatjo, as confirmed in his office, Thursday, July 28, 2011, said the determination was based on evidence and statements of a number of witnesses.

"We set them as suspects, according to the evidence that we found in the forms of financial transaction receipts, documents and the testimony of four witnesses," said Hardjono.

All the suspects were accused of embezzling the 2010 West Papua Regional Budget amounting to Rp22 billion. "The state’s money totaling Rp22 billion were shared among the council members by the secretary with no accountability of its use," said the deputy chief of Papua Prosecutor's Office.

The modus operandi of the budget fund embezzlement was the government of West Papua province handed over Rp100 billion to a regional company namely PT Papua Doberai Mandiri to be managed. However, soon after th money was transferred, Secretary of West Papua Government Marthen Luther Rumadas asked for some of the sum, as loans.

Initially, PT Papua Doberai Mandiri Director Mamad Suhadi objected – although finally on September 17, 2010 Rp 15 billion of fund was disbursed and given to the West Papua regional government secretary. Subsequently, on February 9, 2010 Rp7 billion of fund was disbursed.

Recently it was found out that money was distributed to 44 members of the House of Representatives Secretary of West Papua that. ''We do not know exactly, what for the money was distributed to Council members, because we still have to examine a number of involved parties,'' he said.

Appropriately, if the money was a loan from a regional company, the regional government secretary should repay it, according to the date of the deal or agreement. ''We see indications of fund embezzlement, because the Secretary had no intention of repaying the fund in accordance with the agreement. And ironically, after investigation, all of the money was distributed among the council members without any clear reason."

Currently, the Deputy Chief of Papua Prosecutor's Office went on, his party has sent a letter of request to the Home Affairs Minister to examine those 44 lawmakers. ''Today we have sent the Home Affairs Minister a letter of request of examination of, if in the near future there is a reply of approval, then the 44 people would soon be examined,'' he said.

When asked whether there was a suspect in custody, Wakajati acknowledged there was not any. ''We do not make an arrest until the investigation permit is issue by the Home Affairs minister, "he said.
