VIVAnews – Jakarta High Court ruled to reduce the sentence of Jamaah Ansharut Tauhid’s leader, Abu Bakar Ba’asyir, from 15 to 9 years in prison.
However, Ba’asyir’s party still refused to accept the verdict. The Muslim Lawyers Team (TPM) chairperson Mahendradatta told that the court was not yet independent in processing the appeal of Ba’asyir, who was previously sentenced by the South Jakarta District Court judges. Ba’asyir will file an appeal.
“Now we haven’t received the decision of the appeal. We will file the second appeal upon receiving the copy of the decision,” he said in Solo, Friday.
He went on to say, TPM questioned the stance of the judges who accepted the witness’ being examined through teleconference. If the witness was in fact afraid to meet with the defendant, the judges should have been able to tell the latter to exit the court room. “This is already regulated in the Criminal Code,” he said.
In the mean time, one of TPM members Ahmad Michdan said the filing of the appeal was completely Ba’asyir’s wish. This is because Ba’asyir sent an SMS to his guard, Hasyim Abdullah.
The Ba’asyir’s SMS says: “I reject the decision of the appeal for 9-year imprisonment sentence. I have been wronged, punished for implementing Islamic sharia law. My lawyer will file an appeal for this mistaken verdict.”
Earlier, the first-level court (district court) found Ba’asyir having schemed and/or ordered other people to raise funds which were used for terrorism crime. The funds that were managed to be collected amounted to Rp350 million, in details: Rp150 million from Haryadi Usman and Rp200 million from Syarif Usman. However, Ba’asyir’s party denied this.
