VIVAnews – The Indonesian government claimed the proposal of purchasing PT Newmont Nusa Tenggara’s divestment stakes to the Constitutional Court is aimed at working on the government’s rights. Finance Minister Agus Martowardojo said the proposal is intended as a solution to the dissenting opinion among members of the House of Representatives (DPR) on whether or not to acquire Newmont’s shares.
Agus still believed that the government must approach PT Newmont through the Government Investment Center (PII) and does not need the House’s permission as it has been part of the work contract agreement. “It is the government’s right and authority,” he said.
The Constitutional Court held a hearing of Disputes Among State Institutions on Tuesday, Feb 21. The hearing discussed about the government’s lawsuit against the House of Representatives and the Supreme Audit Agency on the 7 percent divestment shares of PT Newmont Nusa Tenggara.
The spokesperson and also one of the Constitutional Court’s judges, Akil Mochtar, stated that the lawsuit touches on the government's disagremeent over House's approval of the purchase.
The dispute has been in place since last July. The House’s Finance Commission asked Agus to cancel the purchase and to discuss the matter in the first place with the House.
Similarly, the Supreme Audit Agency seconded the House’s opinion that the purchase must be approved by the House. On the other hand, the Finance Minister stated that this investment does not need the House’s permission.
